Carasun Pty Ltd trading as First Choice Realty NSW (A.B.N. 30 080 313 382) (we, us, our) is committed to complying with its obligations under the Privacy Act 1988 (Cth) (the Act).

The Act allows personal information to be collected, used and disclosed for the purposes for which it was collected in accordance with the Act.

This Privacy Policy only applies to the extent we collect, use and disclose personal information in connection with this website.

We also have a privacy policy which details our policy in connection with our real estate and/or strata agency business. A copy of this privacy policy can be accessed at our office and is available upon request.

This Privacy Policy may be revised, updated or replaced from time to time and we may subsequently notify users of any changes to it by posting the revised, updated or replaced Privacy Policy on this website.  Any changes to it take effect on the date on which the revised, updated or replaced Privacy Policy is posted to this website.

What information do we collect?

We collect personal information that is reasonably necessary for one or more of our real estate functions or activities.

The type of information that we collect, and hold may depend on your relationship with us. For example: 

  1. Potential Employee: if you are a candidate seeking employment with us, we may collect and hold information including your name, address, email address, contact telephone number, gender, age, employment history, references, resume, medical history, emergency contact, taxation details, qualifications and payment details.
  1. Customer: if you are a customer of ours, we may may collect and hold information including your name, address, email address, contact telephone number, gender, age, bank details and next of kin. 
  1. Supplier or Creditor: if you are a supplier or creditor of ours, we may collect and hold information including your name, address, email address, contact telephone number, business records, billing information, and information about goods and services supplied by you.
  1. Sensitive information: we will only collect sensitive information where you consent to the collection of the information and the information is reasonably necessary for one or more of our functions or activities. Such functions include if you apply for a rental property or enquire to either lease or purchase one of our properties. Sensitive information includes, but is not limited to, information or an opinion about racial or ethnic origin, political opinions, religious beliefs, philosophical beliefs, membership of a trade union, sexual preferences, criminal record, health information or genetic information. 

If you feel that the personal information that we are requesting at any point is not information that you wish to provide, please feel free to raise this with us. 

Why do we collect this information?

We may collect, hold, use and disclose your personal information for the following purposes:

  1. To provide and administer our products and services, including market properties for vendors and landlords, facilitate transactions for sales and leasing, verify your identity, conduct credit checks and process payments if applicable;
  1. To respond to your submissions and enquiries about our products and services and property listings;
  1. To provide customer support, including conducting, investigating and responding to enquiries, surveys, feedback, comments and complaints;
  1. To distribute our marketing and other communications either alone or with the assistance of service providers on information about us, our property listings and our related products and services;
  1. To plan, market, host and facilitate our events;
  1. To inform and conduct marketing activities including to promote our products and services;
  1. To assess the performance of our website and improve the operation of the website;
  1. To manage and carry out our business and operational functions, including HR management, business decisions and assessing your suitability for appointment as an employee; and
  1. To maintain records and comply with our legal obligations.

Information disclosed

We will use and disclose personal information only for the purposes for which it is collected in accordance with the Act, including:

  • providing services and customer support, including service updates;
  • maintaining and updating our records;
  • comparing information for accuracy, and verifying it with third parties; and
  • providing information as authorised or required by law or a relevant government body or authority.

We can collect personal information about you from other sources in any manner permitted by the Act.  We will only collect personal information from other sources where it is reasonably necessary for us to do so in relation to, or in connection with, any services we are supplying in connection with our real estate and/or strata agency business.  

Examples of such sources of personal information include: 

  • from your agents, other owners, insurers and underwriters, contractors, legal, financial and other advisors in relation to or in connection with any tenancy, lease or contract for sale of the property;
  • from public registers;
  • from publicly available information;
  • from property valuers or related service providers; 
  • from our other service providers including any third party that has been authorised to supply us with personal information; 
  • by entering competitions, promotions, or requesting information or material from us; 
  • completing surveys, providing feedback or complaining to us; 
  • publicly available sources of information or any other organisations where you have given your consent; and
  • social media. 

Anonymity

General users of the website do not need to disclose their identity to us in order to use this website. This website does not, therefore, collect personal information about people who generally access it except in the circumstances described above.

Cookies

A cookie is an electronic token that is passed to the user’s browser which passes it back to the server whenever a page is sent to the user. Our servers may generate cookies which are used to keep track of the pages that users have accessed while using the website. The cookie also allows data to be inputted into a form or template and temporarily stored until the user chooses to save that form or template. Marketing and opt-out
We may also use the information, including personal information (excluding sensitive information), provided by users of this website for marketing and research purposes, to analyse and improve products, benefits and services and to inform users of products, services and benefits provided by us, our related entities, suppliers or sponsors which we consider may be of value or interest to users, unless the user tells us, or has previously told us, not to. Accessing your Personal Information

Users of the website whose information we either collect, use or disclose have the right to request access to any personal information held by us which relates to them, unless we are permitted to withhold that information. We may charge a reasonable fee where access to personal information is provided. Any requests for access to a user’s personal information should be made in writing to the Privacy Officer (details specified below). The user also has the right to request the correction of any personal information which relates to them that is inaccurate, incomplete, irrelevant, misleading or out-of-date.

Acceptance of this Privacy Policy

By using this website, accessing any of our products, services or features, the user acknowledges that it has read, understands and accepts this Privacy Policy and the permissions to collect, use and disclose personal information, and the user authorises us to collect, use and disclose, in accordance with the Act, their personal information for the purposes specified in this Privacy Policy.

Although First Choice Realty NSW intends to observe this policy at all times, it is not legally binding on Carasun Pty Ltd trading as First Choice Realty NSW in any way unless as otherwise described as required under the relevant legislation. From time to time First Choice Realty NSW may regard it as necessary or desirable to act outside the policy. First Choice Realty NSW may do so, subject only to any other applicable contractual rights you have and any statutory rights you have under the Act or other applicable legislation.
